Daily Harvest Sued Over Illness Linked to Products

Mail-delivery health-food company Daily Harvest is amid a lawsuit for traces of foodborne illnesses in their products. On Monday, an Oklahoma woman by the name of Carol Ann Ready sued the health-food giant, alleging she was hospitalized because she ate the company’s “French Lentil + Leek Crumbles,” and she eventually had to have her gallbladder removed.

According to Daily Harvest, nearly 470 people have reported that they have suffered from illnesses after consuming the crumbles. Attorney of Ready, Bill Marler, has said that he now represents over 100 people with potential claims about the company.

Marler said in a statement, “All of these people are relatively young, healthy people, and all of them are having essentially the same symptoms and the same liver dysfunction and the same pain.”

Additionally, On Monday, Daily Harvest’s CEO and Founder, Rachel Drori, stated that the company had been working with the Food and Drug Administration and other experts to investigate the issue at hand. Drori says, “Despite consulting with numerous experts, cooperating with FDA’s investigation, working with our supply chain, and conducting extensive testing, we have not yet identified a cause. I recognize this is frustrating. I am incredibly frustrated.” Drori also added in her statement that tests had come back negative for Listeria, E.Coli, Salmonella, Staphylococcus Aureus (Staph), B.Cereus, and Clostridium Species. 

Despite this, Ready has said in the lawsuit that she ate the lentil meal on May 29 and soon after experienced abdominal and shoulder pain and went to the hospital for the pain. She was later admitted to the hospital with elevated liver enzymes and then was later diagnosed with gallbladder and liver dysfunction. 

Ready states that her doctors had told her the condition could cause indefinite pain and recommended that she remove her already damaged gallbladder. 

Besides the statement made by the CEO and Founder on Monday, Daily Harvest has not made any recent statements about the incident or the lawsuit.
