NYC Welcomes Back Year-Long Outdoor Dining

New legislation loosening the restrictions on outdoor dining in New York City was signed by Mayor Mamdani Monday morning. This new law, sponsored by Council Member Lincoln Restler, amends previous legislation that, for six years, required City restaurants participating in the City’s outdoor dining program, Dining Out NYC, to take down outdoor dining setups between November 30 and March 31.

“The Adams-era regulations nearly broke outdoor dining, but this law will successfully restore outdoor dining to neighborhoods across the five boroughs,” said Council Member Lincoln Restler. “Too many restaurants and cafes have been locked out of our roadway dining program by unnecessary red tape and seasonal restrictions. We are transforming the public realm by making it easy for thousands of restaurants to offer roadway dining.

This requirement led to many restaurants opting out of outdoor dining, leaving just 1,600 participants, because of the expenses it took to take down and put up these temporary dining spaces. This new law will lead to new measures that will help “winterize” outdoor dining spaces. These new rules are set to be released in the coming months.

“…With the legislation we’re signing today, our favorite restaurants can continue bringing New Yorkers together over good food and great company in every season,” said Mayor Mamdani. “I’m grateful to Council Member Restler for championing this legislation and helping ensure that our streets work for the small businesses and communities that make this city what it is.”

This legislation, which is expected to take effect this fall, is another step in the Mamdani administration’s efforts to lessen the monetary red tape for businesses and restaurants to function properly in NYC.
